Once the scheduling conference has set your arbitration timeline, the process of gathering and exchanging evidence (called discovery) begins. This phase is critical because it provides the factual foundation for your case and gives both sides a chance to review key documents before the hearing.
Preparing Your Legal Argument: The Replead Interview Process
Before discovery is completed, our legal team conducts a replead interview. This is a pivotal step designed to ensure we have your full story, all updated case facts, and can prepare you for the next phases of arbitration.
During this interview, we’ll:

- Verify and clarify information from your intake
- Identify any new claims based on recent legal developments
- Help prepare you for deposition and the witness stand
- Begin drafting a detailed legal pleading to submit to the arbitrator and opposing counsel
This process also helps us determine whether your case may qualify for summary judgment, a strategic motion that could allow the arbitrator to rule in your favor without the need for a full hearing.

What Is Discovery?
Discovery is the formal process where both you and the lender share documents and information relevant to the dispute. This ensures transparency and fairness in the arbitration.

How We Share Evidence with the Other Side
Once collected, our case evidence team bundles all relevant documents into a formal production packet. This is provided to the opposing counsel when requested, as part of the discovery process. We monitor requests closely and ensure everything is submitted on time and in compliance with arbitration rules.

What to Expect Logistically
We’ll reach out to schedule your interview in advance. If possible, we ask that anyone involved in the original transaction (such as co-signers) join the call. You’ll receive a booking link and further instructions via email and text.
Please note: if your case moves forward, another invoice may be issued for the arbitrator’s retainer and post-hearing work. This fee must be paid by the lender by its due date. Failure to do so can result in your hearing being cancelled or rescheduled.
